Agreement

These Terms of Service ("Terms") govern your access to https://cesspower.com (the "Site") operated by Cesspool Powersports LLC doing business as Cesspool Powersports ("Cesspool Powersports," "we," "us," or "our"). By using the Site, you agree to these Terms. Professional services are governed by separate written agreements (statements of work, proposals, or contracts) that supersede these Terms where they conflict.

Services

Cesspool Powersports provides digital professional services including brand and design, marketing and advertising, AI tooling and automation, and software development. Service scope, fees, timelines, and deliverables are defined only in a signed or mutually accepted agreement — not by information on this Site.

Intellectual property

Unless otherwise agreed in writing, all Site content (text, graphics, logos, layout) is owned by Cesspool and may not be copied or reused without permission.

For client projects: ownership of deliverables, licenses, and pre-existing materials are defined in the applicable service agreement. Until fees are paid in full, Cesspool may retain rights as specified in that agreement.

Client responsibilities

• Provide accurate information and timely feedback needed to perform Services
• Ensure you have rights to materials you supply (content, logos, data, code)
• Use deliverables in compliance with applicable law

Disclaimer of warranties

THE SITE AND ANY INFORMATION ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SITE. PROFESSIONAL SERVICES WARRANTIES, IF ANY, ARE SET OUT IN SERVICE AGREEMENTS ONLY.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CESSPOOL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SITE. OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). LIABILITY FOR PROFESSIONAL SERVICES IS LIMITED AS SET FORTH IN THE APPLICABLE SERVICE AGREEMENT.

The Site may link to third-party websites (including NK Powersports). We are not responsible for their content or practices.

Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Disputes shall be brought in courts located in Virginia, unless otherwise required by applicable law.

Changes

We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
